WAL-MART V. BRAUN & HUMMEL

Issue: Class Action Certification Standards
Court: U.S. Supreme Court
Lower Court: Supreme Court of Pennsylvania and the Superior Court of Pennsylvania

RLC's Position:
The RLC filed an amicus brief to the U.S. Supreme Court in support of the employer’s petition for certiorari. The brief asks the Court to grant review in order enforce its precedents and ensure that lower Courts comply with the rigorous requirements for class certification in the wage-and-hour context. Ignoring the requirements denies retailers who are faced with class actions their Due Process right to litigate defenses to each individual claim.

Case Outcome:
The Court denied Wal-Mart's petition for certiorari.
