​RLC's Position:
The RLC joined a brief asking the Second Circuit to affirm the lower court's dismissal of the EEOC's nationwide pattern or practice sex discrimination suit against the employer because the agency failed to conduct its mandatory pre-suit investigation in a manner that was consistent with the scope of the claims.

Case Outcome: 
The Second Circuit concluded that under Title VII, courts may review whether the EEOC conducted an investigation, but not the sufficiency of an investigation and found that the EEOC conducted an investigation. The lower court’s order granting summary judgment was vacated and the case was remanded.
