RLC's Position:
The RLC filed an amici brief in this appeal of a lower court’s decision allowing the Equal Employment Opportunity Commission (EEOC) to use the proof structure of §707 of Title VII of the Civil Rights Act, which was designed for equitable relief in “pattern or practice” actions, to seek monetary relief for alleged individual violations under §706. The brief further underscores EEOC’s failure to comply with its statutory duties to investigate a charge before suing and to attempt conciliation. The RLC’s brief asks the 5th Circuit to reverse the lower court’s decision.
