Navigating Packaging EPR

For chief legal officers and legal direct reports, packaging EPR presents more than an environmental compliance issue. These laws raise cross-functional legal and business considerations involving potentially material financial exposure, producer responsibility, supplier and private-label relationships, data controls, contract allocation, enforcement risk, and board-level sustainability commitments. Already in place in 7 states, and with at least half a dozen states considering active packaging EPR bills, obligations for retailers are not going away.
