The RLC joined a brief to the U.S. Court of Appeals for the Fourth Circuit in support of the employer asking the appellate court to affirm the district lower court’s decision that, contrary to the Equal Employment Opportunity Commission’s (EEOC's) allegations in the case, the mere use of criminal background and credit checks is not a violation of Title VII, but instead depends on the specific information collected from the use of the policy and how that information is used.
The 4th Cir. affirmed the lower court's grant of the employer's motion for summary judgment finding that the court did not abuse its discretion in excluding the EEOC's expert reports as unreliable under Rule 702.
