The Advocacy Division advances the retail industry’s legal positions through strategic amicus advocacy in appellate courts. The Division identifies precedent-setting cases and coordinates input from retail corporate counsel and experienced appellate lawyers on legal issues impacting retailers.
Retailers regularly face legal issues with broad implications for the industry, particularly as courts consider cases that may shape precedent affecting retail operations nationwide. Appellate litigation presents a critical opportunity for the retail industry to ensure its legal perspectives are considered in decisions that extend beyond any single case.
The Advocacy Division helps retail corporate counsel engage in this process by identifying significant litigation issues and selecting cases where those issues can be effectively addressed through amicus advocacy. Through coordinated participation, the Division supports thoughtful, industry-informed legal arguments presented to appellate courts.
The Retail Litigation Center files approximately 20 amicus briefs each year, with more than 200 briefs submitted to date. These briefs are authored by experienced appellate counsel recommended by the Advocacy Division and reflect coordinated input from retail members across the industry.
Participation in the Advocacy Division is open to all retail members. Members may join the Advocacy Division distribution list to receive updates on potential cases and opportunities to provide input. Additional opportunities are being developed for members to collaborate directly with a network of appellate specialists supporting the Advocacy Division’s strategic initiatives.
