RLC’s Position: The RLC argues that litigation should be automatically stayed while an appeal on arbitrability is pending. Allowing cases to proceed simultaneously in court undermines the efficiency and cost-saving benefits of arbitration, exposes businesses to duplicative proceedings, and weakens the enforceability of arbitration agreements relied upon by retailers and other consumer-facing companies.
