Coinbase, Inc. v. Bielski
Legal Brief
Coinbase, Inc. v. Bielski
Court: U.S. Supreme Court
Date: February 28, 2023
Issue on Appeal: Whether a district court must stay litigation while an interlocutory appeal is pending on the denial of a motion to compel arbitration under the Federal Arbitration Act.
RLC’s Position: The RLC argues that litigation should be automatically stayed while an appeal on arbitrability is pending. Allowing cases to proceed simultaneously in court undermines the efficiency and cost-saving benefits of arbitration, exposes businesses to duplicative proceedings, and weakens the enforceability of arbitration agreements relied upon by retailers and other consumer-facing companies.
Other Amici: The United States; Chamber of Commerce of the United States; other business and arbitration-focused organizations.
Counsel: Carter G. Phillips, Kannon K. Shanmugam, and other counsel for amici supporting petitioner.
