RLC's Position:
The RLC asked the U.S. District Court of Arizona and the U.S. District Court of New Jersey to grant Wyndham's motion to dismiss the Federal Trade Commission's (FTC's) attempt to use its Section 5 "unfair trade practices" authority as a basis to require specific data security measures after Wyndham had been victimized by hackers.

The New Jersey district court denied Wyndham's motion to dismiss.
