RLC’s Position: The RLC’s brief, filed in a case concerning whether Section 638.51 (covering pen registers) of the California Invasion of Privacy Act (CIPA) applies to the routine use of internet web trackers, (1) explains how retailers have faced a flood of lawsuits that have nothing to do with protecting privacy but are filed by repeat law firms/plaintiffs, and (2) argues that the statutory text and structure demonstrate that this section of CIPA does not apply to routine data collection by a website.
