RLC’s Position: The RLC’s brief reflects on the appropriate standard of review for consumer deception claims in advertising under Washington state’s Consumer Protect Act. The brief reviews the legislative history to provide support for the “reasonable consumer” standard (rather than a “least sophisticated consumer” standard) and provides smart, practical reasons why full terms & conditions cannot be included in advertising.
