RLC’s Position: The RLC’s brief urges the district court to allow an interlocutory appeal to determine whether Washington’s Commercial Electronic Mail Act (CEMA) is preempted by federal law or violates the dormant commerce clause.  The brief explains how CEMA claims threaten massive, coercive liability for retailers nationwide and argues federal law should preempt state rules that regulate commercial email beyond narrow fraud-based limits.
