ROBERTS V. ATT MOBILITY

Issue: Arbitration Agreements
Court: U.S. Court of Appeals for the Ninth Circuit

RLC's Position:
The RLC filed a joint amici brief with the U.S. Court of Appeals for the Ninth Circuit to weigh in on the constitutionality of arbitration agreements. The RLC brief added to the party brief by building out support for the argument that arbitration agreements are no different from other contracts, and therefore, the Constitution does not render arbitration agreements as such unconstitutional.

Case Outcome:
The Ninth Circuit held that the arbitration agreement must be enforced.
