RLC's Position:
The RLC urged the National Labor Relations Board to reconsider its approval of a "microunion" comprised of the cosmetics and fragrances departments and affirm that Specialty Healthcare is not the appropriate standard to determine bargaining units in the retail context.
Case Outcome:
The NLRB found the cosmetics and fragrances employees are a readily identifiable group who share a community of interest and that the employer has not demonstrated that its other selling employees share an overwhelming community of interest with the cosmetics and fragrances employees. Under Specialty Healthcare, the petitioned-for unit is appropriate.
