Airlines Service Providers Association v. Los Angeles World Airports
Issue: Labor
Court: U.S. Supreme Court
Term:
Oral Argument:
Vote:
Opinion:
Lower Court: U.S. Court of Appeals for the Ninth Circuit
Question Presented:
Does the “market participant” exception allow a state or local government to impose an otherwise preempted rule on private companies even if the government is not procuring any good or service from them?
RLC's Position:
The Retail Litigation Center joined the U.S. Chamber of Commerce in filing an amici brief in support of the petition for certiorari and asking the Court to correct the Ninth Circuit's virtually limitless interpretation of the "market participant" exception because it enables localities to aid union organizing in a way that impinges on federal laws governing labors and interstate transportation.
Case Outcome:

- Petition for Certiorari, February 2018
