Regulatory Implications for Consumer Products under TSCA

Congress significantly amended the Toxic Substances Control Act (TSCA) in 2016 with the Frank R. Lautenberg Chemical Safety for the 21st Century Act (a/k/a “new TSCA”). This broadened TSCA beyond its traditional application to manufacturing, processing, or distributing industrial chemicals. Under “new TSCA” the U.S. Environmental Protection Agency (EPA) has the authority to regulate chemicals contained in consumer products such as textiles, carpet, furniture, electronics, and household appliances.
