In a case alleging that Wal-Mart discriminated in hiring and promoting women, a 6-5 majority of an en banc Ninth Circuit panel affirmed the district court’s certification of a massive class of plaintiffs.

On December 6, 2010, the Supreme Court granted certiorari in Wal-Mart v. Dukes to review certification of a massive class in a case involving allegations of discrimination in hiring and promoting women.

Jock et al. v. Sterling Jewelers, Inc.
In a case alleging that chain retailer Sterling Jewelers discriminated against women, the S.D.N.Y. held that class arbitration cannot proceed because the arbitration agreement does not explicitly permit it. 

Roundy's Inc. and Milwaukee Bldg. and Constr. Trades Council, AFL-CIO
The company in this proceeding is Roundy’s, which operates grocery stores in Wisconsin.  It expelled picketing union members from its 26 stores, leading to the current action.  An administrative law judge held that Roundy’s had discriminated against unions in violation of Section 8(a) of the National Labor Relations Act (29 U.S.C. § 158).  In deciding the case, the NLRB has asked for amici to weigh in to help it decide when companies have discriminated against unions.

Microsoft Corp. v. i4i Limited Partnership, et al.
In Microsoft Corp. v. i4i Limited Partnership, the US Supreme Court granted certiorari to address whether the statutory presumption of patent validity continues to apply when an issued patent is attacked based on prior art which was not on the record before the United States Patent Office (USPO) during prosecution.

TCF National Bank filed suit in federal court in South Dakota, seeking an order declaring the debit card interchange fee provisions of the “Durbin Amendment” unconstitutional.
