Issue on Appeal: Whether the district court properly granted petitioner’s motion to compel arbitration and ordered defendant to pay millions of dollars in initial arbitration fees.
RLC’s Position: Today’s model of mass arbitration is inherently at tension with ethical requirements of client engagement and case administration. The RLC amicus brief provides the Court with context on mass arbitration and the many ethical considerations leading to Defendant’s reliance on a AAA provision allowing a party to give claimants the option to pay initial fees.
