RLC’s Position: 
In a case of alleged employment discrimination, the RLC asked the Second Circuit to affirm that parties may not be compelled, but must agree, to participate in class arbitration.

Case Outcome:
The Second Circuit reversed the lower court’s decision vacating the arbitration award and remanded with instructions to confirm the arbitration award.
