RLC's Position:
The RLC filed a brief with the U.S. Supreme Court in support of the employer in Family Dollar v. Scott. The brief asks the Court to clarify when a federal court can use pendent appellate jurisdiction and to reinforce that lower courts should follow the mandates of Wal-Mart v. Dukes, particularly with respect to commonality, when certifying a class.

Case Outcome: 
The Court granted the RLC's motion for leave to participate, but denied the petition for certiorari.
