RLC's Position:
The Retail Litigation Center filed an amicus brief asking the Ninth Circuit to reverse the lower court’s decision that allowed the City of San Francisco to compel businesses to place a misleading warning on its advertisements for certain sugar-sweetened beverages. The RLC’s brief explains that San Francisco’s ordinance allows the government to compel speech that, if made by a private seller would subject that seller to false advertising claims. The brief asks the court to reverse the lower court’s judgement.
