U.S. EPA has published its final TSCA Section 8(a)(7) rule for reporting on the manufacture and import of a large class of chemicals meeting the structural definition of per-and-polyfluoroalkyl substances (PFAS), including PFAS contained in articles (e.g., consumer products). The final rule retained an extensive retrospective reporting period dating back to 2011 as well as ongoing reporting requirements. For many retailers, this may be a first experience with having TSCA reporting obligations.
