Mach Mining v. EEOC

Issue: Labor/Employment
Court: U.S. Supreme Court

Term: October 2014
Oral Argument: January 2015
Vote: 9-0
Opinion: Justice Kagan
Lower Court: U.S. Court of Appeals for the Seventh Circuit

RLC's Position:
The RLC filed a brief urging the U.S. Supreme Court to grant the petition and reverse the 7th Circuit's finding that the Equal Employment Opportunity Commission's (EEOC's) statutory duty to conciliate is not judicially reviewable. Statutory history demonstrates that EEOC compliance with its statutory duty is well within the Court's right to review.

Case Outcome:
The court unanimously held that the EEOC's conciliation efforts are judicially reviewable.
