Consumer Privacy and Data Security
As the saying goes, with great power comes great responsibility. Retailers understand that consumer data should be used judiciously and with utmost caution. While retailers are in strict compliance with a large range of data requirements, flawed proposals at the state and federal level, are attempting to stifle innovation.
RILA has developed, and promoted, an industry consensus on federal data breach legislation that contains strong preemption, capped penalties, a harm and information acquisition based trigger for breach notification, and reasonable data security requirements. RILA is also engaging with a wide variety of stakeholders to tell the story of retailer technology innovation and to raise concerns about issues, such as the frivolous Telephone Consumer Protection Act litigation, that stands in the way of more robust privacy enhancing consumer interactions.
