EEOC v. CVS

Issue: Labor/Employment
Court: U.S. District Court for the Northern District of Illinois

RLC's Position:
The RLC filed a brief with the U.S. District Court of Northern Illinois in support of CVS's motion to dismiss in a case where the Equal Employment Opportunity Commission (EEOC) sued the employer alleging  that its separation agreement violated Title VII. The brief argues that CVS's separation agreement is indistinguishable from the type of agreement that retailers use industry-wide, benefits both the employer and the employee, and is routinely approved by federal courts. If the EEOC were successful, businesses would be left without a clear standard for industry practice for the use of severance agreements.

Case Outcome:
The court granted CVS' motion to dismiss.
